Electoral College Votes for Joe Biden

Legal challenges continue.

On Monday, former Vice President Joe Biden clinched 306 Electoral College votes to secure the presidency. Senator Mitch McConnel acknowledged the results from the Senate floor with congratulations.

Others stopped short of congratulations, but acknowledged that President Donald Trump has a “very, very narrow path” to overturning the election results.

Senator Lindsey Graham of South Carolina said, “I don’t see how it gets there from here, given what the Supreme Court did. But having said that, I think we’ll let those legal challenges play out.” There are still legal challenges pending in state courts.

Some in the House of Representatives have urged the president not to concede and to press for a floor fight over the election loss. When asked if President Trump should concede, Representative Jim Jordan of Ohio said bluntly, “No. No way, no way.”

Debates on the House floor on January 6 could still be at hand. Representative Matt Gaetz of Florida said, “There are members who believe there could be value in having a substantive debate of what occurred in states with substantial irregularities. I don’t believe that 10 hours of debate on that subject would imperil the union.”

Representative Steve Scalise, the minority whip, said, “What I’ve said all along is there’s a legal process that President Trump has been following and that’s what the law allows and let’s let the process run through.”

The 12th Amendment to the U.S. Constitution outlines the necessary procedure for electing the president and vice president. Contested electors could still be rejected which would pave the way for the U.S. House to re-elect President Trump under what’s known as a contingent election.
